  • Assets included in this sale may be used, therefore inspection is highly recommended prior to bidding. Photos and descriptions should be used as a guide only.
  • Delivery is NOT an option for this sale. The removal of goods purchased is the buyers’ responsibility.
  • Please take care when making a bid, as once your bid is placed, it cannot be withdrawn and will not be cancelled. If you are unsure, do not bid, as NO refunds will be given.

Asset Inspection

Inspections are being made available at a Dtae TBA.  Due to the Covoid 19 pandemic Masks and Hand Santisation are required.  Bids on assets in this sale should be made based on the bidders assessment of the goods. Descriptions and photographs should be used as a guide only. If you are unsure do not bid as no refunds will be given. Electrical (if any) items in this sale may not have been tested.

Site Access:

Persons under the age of 16 years will not be permitted on site unless accompanied by an adult and supervised on site.

It is a condition of entry that all persons entering the site;

  • comply with any directions given by Sydney Auctions staff, their representatives or the site controller.
  • that all persons conduct themselves in a manner which does not endanger the health and safety of other persons on site and which does not create a risk to health and safety. 

Personal Protective Equipment (PPE):

Sydney Auctions will specify, according to the hazards and risks assessed as present on the site, any mandatory PPE required to be worn prior gaining approval to entry to the site. This equipment may include Safety Footwear, Safety Eyewear, Hearing Protection, and Head Protection, Face Masks, or any other item of PPE deemed necessary.

TERMS & CONDITIONS OF SALE

For the purposes of these Terms & Conditions, “Sydney Auctions” refers collectively to & hereafter; Sydney Auctions Pty Ltd, Sydney Auctions Online, Sydney Online Auctions, SA, the business, the Auctioneer, Auctioneer & related entities thereof.

GENERAL
By agreeing to the Terms & Conditions of Sydney Auctions, you agree to all of the following, as well as any further conditions contained in individual website pages.  It is advisable to read all the Terms & Conditions before you place a bid.

Sydney Auctions reserves the right to suspend or terminate a bidder’s participation in this or any future sale, as a result of any of the following:

a) Attempts to manipulate the sale process
b) Fraudulent activity
c) Bidding on behalf of another bidder
d) Use of any device, software or instruction to interfere with the Sydney Auctions Online Auction website
e) Refusal to pay outstanding amounts

Sydney Auctions will take all reasonable steps to process your bid, however, Sydney Auctions, nor its related entities, or any of its employees or agents, accepts any liability for losses arising from failed bids as a result of any technical error(s) or any other technical or operational problem.

The Vendor or Sydney Auctions on behalf of the Vendor, reserves the right to withdraw lots.

REGISTRATION

a) When you register you must not provide false or misleading information
b) You agree that by bidding you have entered into a legal agreement to purchase
c) You are responsible for the security of your username and password.  Unauthorised usage will not negate your liability.  If you think that someone who is not authorised by you is bidding on your behalf, you must notify Sydney Auctions immediately.
d) You agree to receive emails from us in notification of bids, winning bids, invoices, and other promotional material.

SALE CONDITIONS

a) By bidding you have agreed to all Terms & Conditions contained within this site.
b) Sydney Auctions strongly recommends bidders familiarise themselves with any additional conditions relevant to particular Lots.
c) If an inspection is available by appointment, we recommend you undertake an inspection.
d) Assets for which an inspection is not available, by bidding you accept the asset “AS IS”.
e) Photographs and descriptions are provided as a guide only.
f) Be certain of your bid, as it cannot be cancelled once it is processed in our system.
g) Sydney Auctions are not under any circumstances obliged to waive or accept a request to waive a bid.
h) When you are the successful bidder, you are liable to pay the winning bid amount, plus the variable Buyer’s Premium and plus GST.
i) All lots are sold on a GST Exclusive basis and exclusive of Buyer’s Premium. (Please refer the GST Exclusive & Buyer Premium examples as provided at the Sale Information Tab.j) The Auctioneer may, without giving any reason refuse to accept the bidding of any person or persons.k) The Auctioneer reserves the right to refuse any bid which they believe not to be in the best interest of the vendor.
l) The Vendor of the lots, or the Auctioneer on the vendors behalf, may bid on any lot or lots, as many times as they consider to be in the best interest of the Vendor.
m) No sale shall be invalidated by reason of defect or fault in any of the goods sold, or as a consequence of any lot being incorrectly described and no compensation shall be paid in respect of any such faults or errors of description (if any).
n) All lots are sold as they stand, “as is - where is”, no guarantee as to soundness is made.
o) Each lot shall be at the buyers’ risk from the fall of the hammer and must be paid for in full before collection and be taken away by the buyer, at the buyers’ expense.
p) The Auctioneer acts as agent for the vendor in respect to the sale of goods and all disputes (if any) arising from a defect of title, wrong description, warranty or breach of warranty as to fitness or otherwise, must be settled between the vendor and the buyer.

q) If a buyer fails to comply with any conditions of sale, or if funds transferred on account of the purchaser is dishonoured, any money which the buyer may have paid the Auctioneer as a deposit or part payment, shall be absolutely forfeited to the Auctioneer.  The vendor or the Auctioneer shall be at liberty to sue the buyer for damages and / or at the vendors option, resell the lot in any manner and upon such terms and conditions as the vendor and/or the Auctioneer may think proper.

r) It is an offence against the Property, Stock & Business Agents Act 1941 for any person to engage in, or induce, another person to engage in any collusive practice, which may hinder free & open competition.
s) Should any question arise that is not provided for in the foregoing conditions, the decision of the Auctioneers shall be final, from which there is no appeal.
 
BIDDING
 
a) Sydney Auctions may determine a minimum bid price on all lots.
b) Bidding will increase in predetermined increments.
c) You may bid using the normal method or use the Auto Bid function.
d) By using Auto Bid, you are submitting the highest bid you wish to pay, and Sydney Auctions will bid automatically on your behalf up to and including your highest nominated bid.
e) Sydney Auctions cannot increase a bid without your permission, and you should therefore monitor the auction when using the Auto Bid facility.
f) Please note that all winning bids attract a variable Buyer’s Premium and are exclusive of GST.
g) Please see the Bid Examples as provided in the Sale Information Tab.
h) The auction closes at the nominated time when there have been no bids for the last three minutes of the auction.
i) If there has been a bid within the last ten minutes, the auction closing time will be extended and will continue until there is no bidding activity for three minutes.
j) The winning bidder will be notified by email, however even if you do not receive the notification please contact Sydney Auctions.

Sydney Auctions warns buyers;

  1. Sydney Auctions will require proof of identity and will require successful bidders to complete & sign a WH&S notification document and that a photocopy of the successful Bidders Drivers Licence will be taken.
  2. all plant and equipment purchased at the Auction is sold on an ‘as is’ basis and (except to the extent such warranties cannot be excluded by law), the Vendor makes no warranty as to the state of repair and condition of the plant or equipment or its suitability for use for any particular purpose. The purchaser is required to make and rely upon its own investigations and enquiries in this regard;
  3. all plant or equipment offered for sale or purchased at the Auction may not be fit for use in a workplace or otherwise;
  4. the purchaser is responsible for undertaking steps required to eliminate or minimise risks (including as to inspection, storage, operation, cleaning, maintenance or repair of plans or equipment);
  5. breaches of the Work Health and Safety Act 2011 and the Work Health and Safety Regulation 2017 carry penalties for people who purchase and operate unsafe equipment without conducting a safety inspection to the required standard (including by performing any calculations, analysis, testing or examination) and ensuring, to the required standard, that the equipment is safe to use and is used safely.
  6. plant and equipment must be given a safety inspection by an appropriately qualified and competent person prior to operation when it is purchased at auction’.
  7. Persons under the age of 16 years will not be permitted on the auction site.
  8. All tradespeople (e.g. electricians, plumbers etc.) will be required to produce relevant licenses and evidence of relevant insurance before commencing work on site.
  9. Forklift, crane drivers, riggers etc. will be required to produce, licenses before commencing work on site.
  10. It is a condition of entry to the site that
  11. all visitors comply with the directions given by Sydney Auctions staff or representatives or the site controller.
  12. all persons conduct themselves in a manner which does not endanger the health and safety of other persons on site and which does not create a risk to health and safety.
  13. Work done on this site must comply with and be completed in a manner compliant with the Work Health & Safety Act 2011 and the Work Health and Safety Regulation 2017.
  14. In carrying out work on the site Sydney Auctions may require persons to consult, coordinate and cooperate as appropriate with other parties in order to comply with requirements under the Work Health & Safety Act 2011 and the Work Health and Safety Regulation 2017.
  15. All power tools and equipment used on this site must be tested (tagged) safe for use in accordance with AS3760 service testing and inspection of electrical equipment.
  16. Based on hazards present on the site, Sydney Auctions staff (or representatives) will specify the mandatory personal protection equipment required to be worn prior to entry to the site. (eg: safety footwear, safety eye wear, face masks, hand santisation, ear plugs, social distancing, hard hats etc.)
  17. The use of certified equipment harnesses, work platforms etc. will be required for any work carried out above 1.8 metres.
