TERMS & CONDITIONS OF SALE
For the purposes of these Terms & Conditions, “Sydney Auctions” refers collectively to & hereafter; Sydney Auctions Pty Ltd, Sydney Auctions Online, Sydney Online Auctions, SA, the business, the Auctioneer, Auctioneer & related entities thereof.
By agreeing to the Terms & Conditions of Sydney Auctions, you agree to all of the following, as well as any further conditions contained in individual website pages. It is advisable to read all the Terms & Conditions before you place a bid.
Sydney Auctions reserves the right to suspend or terminate a bidder’s participation in this or any future sale, as a result of any of the following:
a) Attempts to manipulate the sale process
b) Fraudulent activity
c) Bidding on behalf of another bidder
d) Use of any device, software or instruction to interfere with the Sydney Auctions Online Auction website
e) Refusal to pay outstanding amounts
Sydney Auctions will take all reasonable steps to process your bid, however, Sydney Auctions, nor its related entities, or any of its employees or agents, accepts any liability for losses arising from failed bids as a result of any technical error(s) or any other technical or operational problem.
The Vendor or Sydney Auctions on behalf of the Vendor, reserves the right to withdraw lots.
a) When you register you must not provide false or misleading information
b) You agree that by bidding you have entered into a legal agreement to purchase
c) You are responsible for the security of your username and password. Unauthorised usage will not negate your liability. If you think that someone who is not authorised by you is bidding on your behalf, you must notify Sydney Auctions immediately.
d) You agree to receive emails from us in notification of bids, winning bids, invoices, and other promotional material.
a) By bidding you have agreed to all Terms & Conditions contained within this site.
b) Sydney Auctions strongly recommends bidders familiarise themselves with any additional conditions relevant to particular Lots.
c) If an inspection is available by appointment, we recommend you undertake an inspection.
d) Assets for which an inspection is not available, by bidding you accept the asset “AS IS”.
e) Photographs and descriptions are provided as a guide only.
f) Be certain of your bid, as it cannot be cancelled once it is processed in our system.
g) Sydney Auctions are not under any circumstances obliged to waive or accept a request to waive a bid.
h) When you are the successful bidder, you are liable to pay the winning bid amount, plus the variable Buyer’s Premium and plus GST.
i) All lots are sold on a GST Exclusive basis and exclusive of Buyer’s Premium. (Please refer the GST Exclusive & Buyer Premium examples as provided at the Sale Information Tab.j) The Auctioneer may, without giving any reason refuse to accept the bidding of any person or persons.k) The Auctioneer reserves the right to refuse any bid which they believe not to be in the best interest of the vendor.
l) The Vendor of the lots, or the Auctioneer on the vendors behalf, may bid on any lot or lots, as many times as they consider to be in the best interest of the Vendor.
m) No sale shall be invalidated by reason of defect or fault in any of the goods sold, or as a consequence of any lot being incorrectly described and no compensation shall be paid in respect of any such faults or errors of description (if any).
n) All lots are sold as they stand, “as is - where is”, no guarantee as to soundness is made.
o) Each lot shall be at the buyers’ risk from the fall of the hammer and must be paid for in full before collection and be taken away by the buyer, at the buyers’ expense.
p) The Auctioneer acts as agent for the vendor in respect to the sale of goods and all disputes (if any) arising from a defect of title, wrong description, warranty or breach of warranty as to fitness or otherwise, must be settled between the vendor and the buyer.
q) If a buyer fails to comply with any conditions of sale, or if funds transferred on account of the purchaser is dishonoured, any money which the buyer may have paid the Auctioneer as a deposit or part payment, shall be absolutely forfeited to the Auctioneer. The vendor or the Auctioneer shall be at liberty to sue the buyer for damages and / or at the vendors option, resell the lot in any manner and upon such terms and conditions as the vendor and/or the Auctioneer may think proper.
r) It is an offence against the Property, Stock & Business Agents Act 1941 for any person to engage in, or induce, another person to engage in any collusive practice, which may hinder free & open competition.
s) Should any question arise that is not provided for in the foregoing conditions, the decision of the Auctioneers shall be final, from which there is no appeal.
a) Sydney Auctions may determine a minimum bid price on all lots.
b) Bidding will increase in predetermined increments.
c) You may bid using the normal method or use the Auto Bid function.
d) By using Auto Bid, you are submitting the highest bid you wish to pay, and Sydney Auctions will bid automatically on your behalf up to and including your highest nominated bid.
e) Sydney Auctions cannot increase a bid without your permission, and you should therefore monitor the auction when using the Auto Bid facility.
f) Please note that all winning bids attract a variable Buyer’s Premium and are exclusive of GST.

h) The auction closes at the nominated time when there have been no bids for the last three minutes of the auction.
i) If there has been a bid within the last ten minutes, the auction closing time will be extended and will continue until there is no bidding activity for three minutes.
j) The winning bidder will be notified by email, however even if you do not receive the notification please contact Sydney Auctions.
a) Payment must be made by 4:00pm the day following the Online Auction Close time, by electronic funds transfer (EFT) to;

b) The remittance receipt must be sent to email@example.com with your Bidder Number as a reference.
c) Confirmation of receipt of cleared funds for full payment is required prior to collection.
d) The (or a copy) remittance receipt must be presented to the Sydney Auctions staff or representative(s) when attending the site for collection of purchased goods by the bidder
